The Founders of our great nation knew that the liberties enumerated within the bill of rights could only be if the private citizens and the press had the freedom to speak their thoughts and opinions about the government. Even elementary age children are aware of the First Amendment right to free speech. Apparently such knowledge is not necessarily something required of Kentucky Prosecutors.
One would think that Brian Wright, a Cum Laude graduate from the University of Kentucky College of Law would understand that no judge has jurisdiction or authority to stop non- parties from speaking or reporting about public judicial proceedings. However, that certainly wasn t the case last Wednesday, September 9, 2009.
In Court, without a written motion; Wright requested to Judge Gary Payne that everyone present for the open court proceedings be denied the right to express their opinions about the proceedings until the trial was over. Early on in the hearing the prosecution made exasperating comments twice about the Justice Watch. However it wasn t until the end of the hearing until Wright requested that there be a total restriction on First Amendment rights for every person in the Courtroom.
WHAT IS WRIGHT AFRAID OF?
The case was initiated in 2005. Local Pharmacist Leon Grider filed a lawsuit against Police Chief Joe Michael Irvin and KSP Detective Scott Hammond on August 13, 2005. Two days later Irvin and Hammond then went to personally proceed to arrest Grider at his pharmacy.
Irvin did public TV press releases stating the investigation against then 68 year Leon Grider involved transactions of scheduled narcotics but did state that the alleged transactions did involve money transfers. Irvin insinuations of a more salacious transaction were what prompted the defamation lawsuit by the Girders against Irvin and Hammond.
Four years have since passed. This past Monday on September 14, 2009 assistant Attorney General Thom Marshall and his co-counsel Brian Wright despite knowing for months that a trial date had been set for September 21, 2009 stated that they were not ready to go to trial. This is after a trial date had been set in August 2008 by former judge Cletus Maricle. Due to Wright and his co-counsel not being prepared to go to trial after four years; Judge Gary Payne dismissed all the Russell County criminal charges against Leon Grider.
So is Wright afraid that US Justice Watch is going to report on his lack of being prepared? Or do other cases involving Irvin, Hammond, and Wright sit waiting to be exposed?
