Special Called Meeting of the Russell Springs

There is a special called meeting this afternoon at the Russell Springs City Council. According to WHVE 92.7, the meeting is to address personnel issues. Rampant speculation in the Russell Springs Community is that the special called meeting is about a petition for removal filed in Franklin Circuit Court on June 3, 2009. The petition request that Joe Michael Irvin, the Russell Springs Police Chief be removed from his office due to violations of state and federal statutory guidelines.

More specifically that Russell Springs city employment of Irvin violates 18 U.S.C. 922 (g)(8), (9) and Kentucky statutory requirements that any peace officer not be convicted of a crime involving moral turpitude, nor engaging in any such crime. On April 22, 1992 Irvin agreed that he had committed domestic violence against his wife Tracy Irvin and their daughter. He also agreed to refrain from committing further domestic violence against them. This case was in Pulaski District Court case no. 92-D-0048(1).

Wife beating is an immoral act which falls under moral turpitude. Further, federal law prohibits anyone who has been convicted of domestic violence in any court from receiving, possessing, transporting any firearms or ammunition. The petition request that Joe Michael Irvin be removed from “any form or fashion of a peace officer in and for the Commonwealth of Kentucky” and was signed by several individuals in the community. The case can be found in the Franklin Circuit Court Division II, under Civil Action No. 09-CI-922.

The meeting will be at 4:00 p.m. at the Russell Springs City Hall.
