Special Judge in Corruption Case Gets Indicted By FBI for Corruption

Russell County Kentucky March 19th, 2009; Today the FBI unsealed an indictment which charged Special Judge R. Cletus Maricle who was presiding as the Judge over the cases involving Leon Grider (charged for allegedly illegally distributing prescription drugs,) James Faller (for allegedly owing wages to employees and a second indictment for witness tampering) and Melinda Wilson (who sued the City of Russell Springs and the Chief of Police for allegedly trying to force her to alter evidence and to have sex with the mayor and record it to be used in a blackmail scheme.)

For months James Faller, Leon Grider and Melinda Wilson have been screaming that the courts are corrupt and that the police are getting away with murder, literally. Grider and Faller filed a series of lawsuits against the City, the State, the Police and even one the Russell Springs Mayor called Peter Rabbit in his nefarious effort to mislead the public in a speech he gave at the last meeting of the City Commission before the City became a Mayor strong form of Government. The Complaints filed by Faller, Grider and Wilson (who filed separately) allege exactly the charges that the FBI and the United States Attorneys Office filed against Special Judge R. Cletus Maricle.

You may remember that Faller and Grider finally forced a Special Grand Jury to be convened, only to be met with more corruption by the now disbanded Kentucky Bureau of Investigation, known as the KBI.

When Faller and a group of people began pushing for indictments of Chief of Police Joe Michael Irvin, former Commonwealth Attorney Larry Rogers and a host of other officials The KBI and a Special prosecutor brought in KBI Agent John Dudinskie to work out a solution to the Grand Jury problem.

During the investigation by the Grand Jury Faller filed numerous motions and ultimately a lawsuit to try and stop the witnesses from being harassed as well as the KBI agent (Dudinskie) tampering directly with the Grand Jury. At one point Judge Vernon J. Miniards office contacted the FBI for assistance with the Special Grand Jury due to what was clearly an out of control proceeding. Faller finally went to the Special Judge and was able to convince Maricle to issue an order directing that the KBI and no one else could contact any witness. Maricle swore in the potential witnesses, to no avail.

Faller persisted to locate evidence to prove the whole thing was a bag of corruption and finally obtained a copy of the phone bills of Dudinskie which showed that Dudinskie was in contact with Irvin the entire time that he was supposedly investigating him. Faller further learned from the phone records that Dudinskie left his phone on in the Grand Jury room to allow him to listen in on the Grand Jury and to keep Irvin up to speed on the charges he was being accused of.

Shortly after Faller obtained the phone records of the KBI agent showing the corruption, Special Judge R. Cletus Maricle held an emergency hearing and threatened Faller that he was in contempt of Court and that he would hold him or his attorneys in contempt because AT&T mistakenly sent the records to Faller.

Maricle held a special hearing and directly issued orders to Robert L. Bertram, Joel Smith and J. Vincent Aprile ordering them to appear and explain what took place and made the public statement someone was in contempt and he would decide. In the end, despite the records showing that the KBI and Irvin conspired to tamper with the Jury, or at least eavesdrop on the Grand Jury, Maricle could not find Faller or his attorneys in contempt however, Maricle issued an order sealing the phone records which are prima facia evidence that the KBI and the targets of the Grand Jury were conspiring.

Some time back Judge Maricle was appointed to any and all matters regarding James Faller or Leon Grider. The current charges, although not related in any way to Russell County show that Maricle was in fact an expert in aiding and abetting corruption and racketeering through the use of his office as Judge.

As you can see from the attached documents below, Maricle and 7 others were charged with varying crimes. Maricle was directly charged with Racketeering-Extortion (Count 1); Conspiracy to defraud the United States (Count 10); Influencing/Injuring Officer/Juror/Witness and Aiding and Abetting (Count 7) and Conspiracy Against the Rights of Citizens (Count 9.)

Do these charges sound familiar?, they should, they are exactly what Faller, and Grider charged all the Defendants with and then the Mayor (and the Defendants) who is setting a new high on misleading the public sued Faller and Grider for malicious prosecution. Maricle was the sitting judge in that matter too, presumably to protect that corruption and cover up as well.

  1. It looks like the Wilson lady really screwed up by lying about so much. Why people do such things are beyond me. This is good news for JMI. Too bad. I still believe he is a bad actor.
