Did Rogers threaten the Court?

RUSSELL COUNTY Kentucky; USJusticewatch.Com has obtained a copy of a video recording of a hearing held in Faller v. Tarter wherein the Circuit Judge, Honorable Vernon J. Miniard, Jr., deals with local Commonwealth Attorney (former) Larry Rogers. At this hearing Rogers had filed a motion to quash a subpoena issued by Faller to take Rogers’ deposition. Rogers’ stated concern to the Court was that if he is deposed he believes he will be indicted. Rogers’ reaction was to make threatening innuendos to the Court about jury tampering which was not well received. At the time the hearing took place, Rogers was the Commonwealth Attorney and was succeeded by Matthew Leveridge. Rogers’s was to be deposed regarding his involvement and conduct relating to the false charges brought against Faller by Sam Tarter in a Grand Jury proceeding where Tarter alleged Faller cut trees that turned out to be imaginary [did not exist] on property Tarter sold to Faller’s employer. It turned out later that Tarter actually did not completely own the property and could not sell it to anyone. Faller has maintained that Tarter has an active business relationship with Rogers and that Rogers then law partner and Assistant Commonwealth Attorney David Smith conspired to steal the property back by falsely charging Faller to gain an edge over Faller in the legal proceedings. Following the indictment against Faller, Faller made a direct submission to the Russell County Grand Jury where Tarter was indicted for perjury, false swearing and criminal trespassing when Tarter (allegedly) illegally entered Faller’s home.

Faller agreed to drop his charges (against Tarter) in exchange for Tarter dropping his against Faller and to resolve the matter in a civil lawsuit which is still pending. Almost 30 days exactly following the dismissal of the lawsuit against Tarter, Rogers brought more questionable charges against Faller, most of which have been dropped. In that indictment one of the most outrageous allegations was from a woman who claimed Faller owed her $30,000.00 for two weeks pay while in fact she never worked for Faller and was in a mental institution in Oklahoma at the time she claimed she worked for Faller. Faller has taken several steps to recover property stolen from him and his employer in these matters however, according to Faller, “the Commonwealth has moved heaven and earth to try and protect what he calls, some very corrupt people.”

When matters began coming to light in the public, the Grand Jury foreperson (Cheryl Daniel) of the Grand Jury that indicted Tarter came forward and gave sworn testimony and recorded statements that she was threatened by Tarter and nothing was done about the threats. Daniel also indicated that Tarter came to her office prior to the case against him being heard to try and convince Daniel not to hear Faller and that since she was a local and Faller was not, they should give Tarter a pass. Faller said, “if that was anyone else who did something like that, they would have immediately arrested them for jury tampering and put them under the jail.”
